Prenups Are Not a Red Flag. They’re a Real Conversation.
Prenups have a bad reputation they do not deserve.
For a long time, people treated prenuptial agreements like they were cold, awkward, or only meant for people anticipating that a marriage to fail. But that is not the full story.
A prenup can actually be a grown-up conversation about money, property, expectations, and protection before marriage. And honestly, those conversations are often easier to have before there is a problem.
In Florida, a premarital agreement must be in writing and signed by both parties. It generally becomes effective when the marriage takes place Florida Statute § 61.079. A prenup can address important financial issues, including property rights, business interests, debt, potential spousal support, and what happens to certain assets if the marriage ends.
That does not mean every prenup is automatically problem-free. Issues like pressure, lack of voluntariness, fraud, coercion, or unfairness can matter. That is why it is of utmost importance to handle the process carefully and with proper legal guidance.
A well-thought-out prenup is not about planning for failure. It is about clarity.
It can help both people understand what they are bringing into the marriage, what they want to protect, and how certain financial issues should be handled. For business owners, professionals, people entering a second marriage, or anyone with significant assets or debts, that clarity can be especially important.
The conversation may feel uncomfortable at first. But avoiding the conversation does not make the issues disappear.
