Can You Divorce Your Spouse and Keep Your 3% Mortgage?
A Florida homeowner's guide to keeping the rate, handling the buyout, and getting an ex off the loan.
You are ready to leave the marriage. The 3% mortgage is harder to give up.
Before agreeing to refinance, find out whether the existing loan can stay. Before agreeing to stay on that loan, find out how you will get off it.
Can you keep a low mortgage rate after divorce? Sometimes. A qualifying divorce-related transfer may let the existing loan continue. But transferring the home does not automatically release a borrower from the debt. The loan program, transfer documents, and release requirements matter. Freddie Mac's mortgage-assumption guidance.
Does divorce mean you have to refinance?
Not automatically. Refinancing replaces the existing loan. An assumption involves taking responsibility for an existing loan, potentially preserving its terms.
Federal law limits enforcement of due-on-sale clauses for specified divorce-related ownership transfers involving residential property with fewer than five dwelling units. In plain English, the lender generally cannot demand full repayment solely because a qualifying transfer occurred. That protection does not erase a borrower's debt or settle the spouses' equity claims. 12 U.S.C. § 1701j-3(d)(7).
Do not assume a conventional mortgage rules out every option. Fannie Mae's servicing guide expressly addresses exempt divorce transfers and separately addresses requests for release of liability. For a release, the servicer must find the receiving spouse's credit and financial capacity acceptable. Other loans have their own requirements. Fannie Mae servicing guide.
If you keep the rate, how do you pay your spouse?
The low rate does not fund the buyout.
Imagine a home worth $800,000 with a $400,000 mortgage. That leaves $400,000 before other liens, costs, and adjustments. If the spouses agree to divide that equity equally, the retaining spouse still needs to address a $200,000 payment. Keeping the mortgage does not make that amount available in cash.
Cash, an agreed exchange of other assets, or separately approved financing may be considered. Each affects the settlement differently. Compare liquidity, taxes, borrowing costs, and the full monthly housing budget before choosing.
The equal split in this example is an assumption, not a ruling about your home. Florida begins marital distribution with a premise of equality, subject to statutory reasons for an unequal distribution. Classification and any nonmarital interests also matter. Florida Statutes § 61.075.
What should you ask the mortgage servicer before signing?
Ask for the process for a divorce-related transfer and release of liability, not just a generic refinance quote.
Request written information identifying the loan owner or program, required documents, qualification standards, fees, expected timing, and whether the proposed transaction preserves the current rate and releases the departing borrower.
Start early. The CFPB has documented complaints about delays, repeated document requests, and confusion in divorce-related mortgage processing. A settlement deadline should account for the actual process. CFPB mortgage-servicing report.
What if the release or refinance is denied?
Build the fallback into the agreement before the deadline passes. Counsel should address who pays carrying costs while the application is pending, what proof of progress is required, when any extension is allowed, and what happens if the planned exit fails.
If a sale is the fallback, address listing timing, broker selection, pricing decisions, and cooperation. “We will figure it out later” can leave both people tied to a house neither can resolve alone.
